NOTICE OF SALE BY THE TRUSTEE OF REAL ESTATE LOCATED IN WASHINGTON COUNTY, VIRGINIA Pursuant to a Line of Credit Trust Deed dated November 28, 2012 and filed in the office of the Clerk of the County Circuit Court of Washington, Virginia under number 120006759 (the “Indenture”), default having occurred in payment of the debt secured by the Indenture, and on instruction of the holder of the note secured by the Indenture, the undersigned Trustee will offer for sale the property described below at public auction to the highest bidder at the front door of the Washington County Courthouse, 189 E. Main Street, Abingdon, Virginia, on the 7th June 2022, beginning at 11:00 a.m. and continuing as necessary PARCEL 1: All that parcel of land situated and occurring in the Magisterial District of Harrison, Washington County, Virginia, and described as follows: “DESIGNATED as the plot 4 on the dish titled, “Property of Erby Bott, Washington Co., Virginia, dated March 30, 1968”, recorded in the office of the Clerk of the Circuit Court of Washington County, Virginia, in Plat Book 17, page 92, which Plat is incorporated herein and forms part of it, and to which reference is made for a description of the property here conveyed. BE the same property conveyed to Dewayne H. Fields, et al, Vernon Edwin Heath and Phoebe B. Heath, husband and wife, by deed dated November 28, 2012 and registered in the office of the Clerk of the Circuit Court of Washington County, Virginia, as Instrument No. 120006758. Tax Card No. 102-7-4 PARCEL TWO: “All that certain lot or parcel of land and all improvements and appurtenances thereto belonging, situating, lying and being in the Harrison Magisterial District of Washington County, Virginia, and more particularly described as follows: " DESIGNATED as Lot No. Six (6) as shown on a survey prepared by Gale W. Maiden, CLS, and titled "Plat showing the property of Carl R. Gentry and Bobby N. Gentry”, a copy of which is recorded in the office of the clerk of the Circuit Court of Washington County, Virginia, in Plat Book 24, page 57, to which plat so of record reference is here made for a more specific description of the property hereby ceded. BEING the same property conveyed to Kenneth E. Fields and Tammie D. Fields, husband and wife, as tenants in full with common law right of survivorship by deed dated August 22, 2007 of Tammie D. Fields of Recorded in Instrument # 070006761 at the Washington County Clerk’s Office, Virginia. BEING the same property conveyed to Jerry R. Farley and Jenny Farley, husband and wife, as tenants in full with common law right of survivorship and Jerry D. Farley by deed dated March 4, 2013 of Kenneth E. Fields and Tammie D. Fields, husband and wife registered in Instrument # 130001353 at the Washington County, Virginia Clerk’s Office. ALSO TRANSMITTED herein is this certain 2004 Norris Double Wide Mobile Home, Vehicle Identification Number N01029221TNAB, which is located on the aforementioned property. Tax Map # 081A-1-6 This sale is further subject to all encumbrances, restrictions, rights of way, conditions, easements and liens of mechanics and materials, if any, whether registered or not, in the to the extent that all of the foregoing applies and takes precedence over the trust deed lien. A deposit of ten percent (10%) in cash or by certified check will be required from the purchaser at the time of the sale, except from the holder of the ticket. The deposit, without interest, is applied to the purchase price at the time of payment. Payment will take place no later than 30 days after the sale. In case of failure of the buyer in the purchase, the deposit will be lost and the property will be resold at the risk and expense of the defaulting bidder. In the event that the Substitute Trustee is unable to transfer ownership to the successful bidder for any reason, then, at the sole discretion of the Substitute Trustee, the sale may be canceled and the Bidder’s sole remedy shall be the return of the deposit. The balance of the purchase price must be in cash or its equivalent. Settlement will be made at the offices of the Substitute Trustee or any other mutually agreed location. The property and all improvements thereto are to be sold “as is” without any warranties except to the substitute trustee’s special warranty of title against the person’s claim title through the trustee. The winning bidder will bear all loss or damage to the property from and after the time of sale. The winning bidder will be responsible for all transportation costs, which will be covered by special warranty, including, but not limited to, deed preparation and licensor fee. The sale is subject to such additional terms as the Substitute Trustee may announce at the time of the sale.
