in Michigan Court of Appeals, Michigan Court of Appeals (civil unreported), Opinion Digests

When plaintiffs who own lots in a subdivision bring an action after the defendant homeowners association installed a new swing set and planted a new tree in a common area, a judgment in favor of the defendant must stand despite plaintiffs’ assertion that the installation of the new swing set and the planting of the new tree constitute violations of a restrictive covenant contained in the deeds of all the subdivision lots and incorporated into the defendant’s regulations.
